INTRODUCTION
The Pet Alert websites (regional and national), applications, documentation and related services (collectively, the Platform) are operated by Uzino Sàrl, a company incorporated under Swiss law with its registered office in Leytron, Switzerland (IDE CHE-236.397.546) (hereinafter Uzino, we, us, our).
Any person (the User or you) who accesses the Platform or uses it in any way does so on the condition that they expressly and unreservedly accept these Terms and Conditions of Use (the Terms and Conditions).
1. PURPOSE
These Terms and Conditions define the conditions under which the User is authorised to access the Platform and use the services offered therein.
2. REGISTRATION ON THE PLATFORM
Access to certain features of the Platform requires prior registration, which can be completed using the registration form provided for this purpose.
Registration on the Platform may or may not be accompanied by the conclusion of a service contract between the Platform and the User (the Contract), depending on the user level chosen.
3. USERS
Three levels of Users have access to the Platform:
• the Visitor,
• the Expert,
• the Member,
3.1 Visitor
A Visitor is any User who accesses the Platform.
They may view the public pages of the Platform, including published Alerts.
To comment on Missing Person Alerts or Discovery Alerts, or to submit a Discovery Alert, the Visitor must identify themselves. These actions are free of charge.
3.2 Member
A Member is any person registered with Pet Alert services.
Member status is obtained:
either by publishing a Discovery Alert,
or by ordering a Missing Alert, subject to payment validation.
By becoming a Member via the ordering of a Missing Alert, the User also benefits from subscriber status for a period of one year.
Members may join the Expert programme.
3.3. Expert
The Expert is a member admitted to participate in the Pet Alert Expert search programme.
Expert status is obtained following an application to join the programme and its validation by the Platform.
Experts can, in particular:
• indicate their geographical location,
• provide their mobile telephone number,
• receive Missing Pet Alerts, generally between 8:00 a.m. and 10:00 p.m. on weekdays and between 10:00 a.m. and 10:00 p.m. on weekends and public holidays.
This feature can be enabled or disabled at any time.
The Expert receives Credits for certain actions (sharing ads, relevant comments, creating valid Discovery Alerts, referrals).
Credits can be used to obtain benefits on the Platform (gifts, discounts, etc.). They are neither convertible into cash nor transferable.
Expert status ends in the event of deregistration or profile deactivation. Unused Credits are then cancelled.
4. ALERTS
Missing Alerts concern lost animals and are posted by Members. There is a fee for posting these alerts.
Discovery Alerts allow the location of a lost animal to be reported. There is no charge for posting these alerts.
Missing Animal Alerts are published for a period of 30 days from their activation and can be extended at no additional cost for as long as necessary.
A published Alert cannot be modified, but additional information can be added via comments.
A deactivated Alert is no longer publicly visible, but remains stored in the Platform's databases.
5. COMMENTS
The sole purpose of comments is to help locate a lost animal.
They can only be written by the original author of the Alert.
6. CONTRACT
The description of the services offered is available on the Platform.
By confirming an order, the User makes an offer to enter into a Contract and accepts these Terms and Conditions.
The Contract is concluded at the time of actual payment for the service.
7. PRICES AND PAYMENT METHODS
Services are payable immediately upon ordering. No service will be provided without full payment in advance.
All payments are final and non-refundable.
No right of withdrawal is applicable under Swiss law.
Prices may be changed at any time for future orders.
7.1 Official communication with the Platform
All official communication between the User and the Platform shall be conducted exclusively via the internal messaging system accessible from the user area.
Any communication sent via another channel (e-mail, post, telephone, social media or third-party messaging services) shall be deemed null and void and without legal effect.
8. SEARCH SCOPE
Unless otherwise specified, Alerts may only be distributed in the following countries:
Andorra, Germany, Austria, Belgium, Spain, France, Italy, Liechtenstein, Luxembourg, Monaco, the Netherlands, Portugal, the United Kingdom, Switzerland, Canada and the United States.
9. RESPONSIBILITIES
9.1 Responsibility of the Platform
The Platform undertakes to distribute Alerts in accordance with the services subscribed to, without guaranteeing the location of the animal.
9.2 Limitation of liability
To the fullest extent permitted by law, the Platform shall not be liable for any damage related to the use or inability to use the Platform.
The Platform's maximum liability shall in no event exceed the amount paid by the User.
9.3 User liability
The User is solely responsible for the content they publish and guarantees that they have all the necessary rights.
10. TERMS OF USE
Use of the Platform is restricted to persons aged 18 and over.
Any use for commercial, competitive or unauthorised purposes is strictly prohibited.
Only the owner of the animal is authorised to publish a Missing Alert.
11. INTELLECTUAL PROPERTY
All elements comprising the Platform are the exclusive property of Uzino Sàrl, except for content published by Users.
Any unauthorised reproduction or use is prohibited.
12. SUSPENSION AND DEACTIVATION
The Platform reserves the right to suspend or delete any content or profile in the event of a breach of these Terms and Conditions or for legal or technical reasons.
13. MISCELLANEOUS PROVISIONS
13.1 Language
These Terms and Conditions are written in French.
In the event of any discrepancy, the French version shall prevail.
13.2 Amendments
The Platform reserves the right to amend the Terms and Conditions at any time.
The current version is the one published on the Platform.
13.3 Applicable law and jurisdiction
These General Terms and Conditions are governed by Swiss law.
The place of jurisdiction is Leytron (Switzerland).
